This Client Service Agreement ("Agreement") governs your use of the CommentBy commenting widget service as a paying client ("Client," "you," or "your"). By subscribing to our service, you agree to these terms.

1. Service Description

What We Provide

• A 7-day free trial for all new subscribers with full feature access
• A commenting widget that can be embedded on your website(s)
• Comment management and display functionality
• Automated spam filtering to maintain comment quality
• Access to commenter names and email addresses
• Basic analytics and comment export capabilities

Implementation

• You can integrate our widget on any website you own or control
• No restrictions on website type or domain
• Multiple domain usage allowed per subscription
• Technical support for integration provided

2. Client Responsibilities

Content Moderation

• You are fully responsible for moderating comments on your website
• You must review and manage user-generated content according to your standards
• You are responsible for removing inappropriate, illegal, or harmful comments
• You must respond to user complaints and moderation requests
• You should establish clear community guidelines for your commenters

Legal Compliance

• Ensure your website complies with applicable laws and regulations
• Implement required privacy notices for comment collection
• Handle data protection requirements (GDPR, CCPA, etc.) for your jurisdiction
• Comply with accessibility standards as required

Acceptable Use

You agree not to use our service for:

• Illegal activities or content
• Websites promoting hate speech, discrimination, or violence
• Adult content involving minors
• Spam or fraudulent schemes
• Malware distribution or hacking activities
• Copyright infringement or piracy

3. Data Access and Privacy

What You Can Access

• Names and email addresses of users commenting on your website
• Comment content and timestamps
• Basic engagement metrics
• Export capabilities for your website's comment data

Data Protection Requirements

• You must protect commenter data according to applicable privacy laws
• You cannot share commenter email addresses with third parties without consent
• You must respect user data deletion requests
• You should implement appropriate security measures for accessed data

4. Billing and Payment

Free Trial

• All new subscribers receive a 7-day free trial with full access to features
• You will not be charged during the trial period
• You may cancel at any time during the trial with no charges
• Your first payment occurs automatically after the trial unless you cancel

Payment Processing

• All payments are processed securely through Paddle
• Billing cycles and pricing as displayed on our website
• Automatic renewal unless cancelled
• You are responsible for keeping payment information current

Refunds and Cancellation

• 14-day money-back guarantee from your first paid charge if you're not satisfied
• You may cancel your subscription at any time from your account dashboard
• Service continues until the end of your current billing period after cancellation
• No refunds for mid-cycle cancellations after the 14-day guarantee period
• No refunds for accounts terminated due to Terms violations

5. Service Level and Availability

• We strive to maintain high service availability but provide no specific uptime guarantees

6. Account Violations and Termination

Violation Process

• Warning: First violation results in a warning and request to remedy the issue
• Suspension: Serious violations may result in temporary account suspension
• Termination: Repeated violations or illegal content results in account termination
• No Refunds: Accounts terminated for violations are not eligible for refunds

What Constitutes a Violation

• Using the service for prohibited content or activities
• Attempting to reverse engineer or hack the service
• Violating intellectual property rights
• Failure to moderate illegal content after notification
• Non-payment or chargebacks

7. Intellectual Property

• You retain ownership of your website content
• We retain ownership of our service technology and code
• You receive a license to use our widget during your subscription
• This license terminates when your subscription ends

8. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for user-generated content on your website
• We are not responsible for your content moderation decisions
• Our liability is limited to the amount you paid in the last 12 months
• We are not liable for indirect, consequential, or punitive damages
• You are responsible for compliance with applicable laws

9. Indemnification

You agree to indemnify and hold harmless the operator of CommentBy from any claims, damages, or expenses arising from:

• Content posted on your website
• Your content moderation decisions
• Your violation of these Terms
• Your violation of applicable laws
• Claims by your website users or commenters

10. Data Ownership and Export

• You own the comments posted on your website
• You can export your comment data at any time
• Data export remains available for 30 days after subscription cancellation
• We may delete data after account termination (backup policies apply)

11. Service Modifications

• We may update or modify our service features
• We will provide reasonable notice of significant changes
• Pricing changes will be communicated in advance
• You may cancel if you disagree with material changes

12. Support and Communication

• Technical support provided via email
• Documentation and integration guides available
• Response time: within 48 hours during business days
• Critical issues prioritized

13. Governing Law and Jurisdiction

This Agreement is governed by the laws of Morocco. Any disputes arising from this Agreement will be resolved in the courts of Fes, Morocco.

14. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, or internet outages.

15. Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and us regarding the service. It supersedes all prior agreements and understandings.

16. Amendment

We may modify this Agreement by providing notice and updating the "Last Updated" date. Material changes will be communicated via email. Continued use after changes constitutes acceptance.

17. Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
